The longtime property owner described years of effort on the parcel, said a car wash and other tenants have genuine interest, and asked for relief from the tree ordinance's roughly $200,000 penalty, arguing it's an improper impact fee on commercial sites that can't physically fit replacement trees.

The project's civil engineer explained the site has about 200 trees, only 176 two-and-a-half-inch replacements can fit, and the caliper-inch shortfall triggers a nearly $200,000 penalty even though the landscape plan meets code.
